{"id":1464,"date":"2025-09-18T18:42:57","date_gmt":"2025-09-18T15:42:57","guid":{"rendered":"https:\/\/acar.aero\/?p=1464"},"modified":"2025-09-18T18:45:21","modified_gmt":"2025-09-18T15:45:21","slug":"directiva-nis2-si-implicatiile-pentru-transportul-aerian","status":"publish","type":"post","link":"https:\/\/acar.aero\/en\/directiva-nis2-si-implicatiile-pentru-transportul-aerian\/","title":{"rendered":"NIS2 Directive and its implications for air transport"},"content":{"rendered":"<div class=\"xdj266r x14z9mp xat24cr x1lziwak x1vvkbs x126k92a\">\n<div dir=\"auto\">\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<p data-start=\"332\" data-end=\"549\">The Romanian Airline Companies Association \u201cCarpathia\u201d draws the attention of Romanian aviation operators to the new European regulations on cybersecurity and the obligations arising from the <strong data-start=\"528\" data-end=\"546\">NIS2 Directive<\/strong>.<\/p>\n<h3 data-start=\"551\" data-end=\"569\">What is NIS2?<\/h3>\n<ul data-start=\"570\" data-end=\"933\">\n<li data-start=\"570\" data-end=\"739\">\n<p data-start=\"572\" data-end=\"739\"><strong data-start=\"572\" data-end=\"579\">NIS<\/strong> (<em data-start=\"581\" data-end=\"615\">Network and Information Security<\/em>) was the first European directive (2016) designed to increase the level of cybersecurity across Member States.<\/p>\n<\/li>\n<li data-start=\"740\" data-end=\"933\">\n<p data-start=\"742\" data-end=\"933\"><strong data-start=\"742\" data-end=\"750\">NIS2<\/strong> (Directive (EU) 2022\/2555), adopted in 2022, expands its scope, introduces stricter governance and reporting obligations, and provides for more severe sanctions in case of non-compliance.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"935\" data-end=\"964\">Implementation in Romania<\/h3>\n<p data-start=\"965\" data-end=\"1134\">The NIS2 Directive has been transposed into national law through <strong data-start=\"1002\" data-end=\"1022\">Emergency Ordinance no. 155\/2024<\/strong>, subsequently approved and amended by <strong data-start=\"1052\" data-end=\"1074\">Law no. 124\/2025<\/strong>. In the air transport sector, the obligations apply to:<\/p>\n<ul data-start=\"1135\" data-end=\"1471\">\n<li data-start=\"1135\" data-end=\"1171\">\n<p data-start=\"1137\" data-end=\"1171\">certified air carriers;<\/p>\n<\/li>\n<li data-start=\"1172\" data-end=\"1224\">\n<p data-start=\"1174\" data-end=\"1224\">aerodrome and airport operators;<\/p>\n<\/li>\n<li data-start=\"1225\" data-end=\"1285\">\n<p data-start=\"1227\" data-end=\"1285\">air navigation service providers (ATC\/ANS);<\/p>\n<\/li>\n<li data-start=\"1286\" data-end=\"1328\">\n<p data-start=\"1288\" data-end=\"1328\">maintenance and CAMO organizations;<\/p>\n<\/li>\n<li data-start=\"1329\" data-end=\"1398\">\n<p data-start=\"1331\" data-end=\"1398\">air operators, ATOs, aeromedical centers;<\/p>\n<\/li>\n<li data-start=\"1399\" data-end=\"1471\">\n<p data-start=\"1401\" data-end=\"1471\">auxiliary facility providers and simulator operators.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1473\" data-end=\"1504\">Deadline and sanctions<\/h3>\n<ul data-start=\"1505\" data-end=\"1758\">\n<li data-start=\"1505\" data-end=\"1655\">\n<p data-start=\"1507\" data-end=\"1655\"><strong data-start=\"1507\" data-end=\"1529\">22 September 2025<\/strong> is the deadline for registering the concerned entities with the <strong data-start=\"1590\" data-end=\"1652\">DNSC (National Cybersecurity Directorate).<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1656\" data-end=\"1758\">\n<p data-start=\"1658\" data-end=\"1758\">Failure to register by this date may result in penalties of up to <strong data-start=\"1708\" data-end=\"1755\">EUR 10 million or 2% of turnover<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1760\" data-end=\"1789\">Operators\u2019 obligations<\/h3>\n<ol>\n<li data-start=\"1793\" data-end=\"1862\"><strong data-start=\"1793\" data-end=\"1818\">Registration with DNSC<\/strong> in the official Registry (available online).<\/li>\n<li data-start=\"1793\" data-end=\"1862\"><strong data-start=\"1866\" data-end=\"1905\">Risk and maturity assessment<\/strong> - following registration, entities must carry out a self-assessment in line with the DNSC orders issued in August 2025.<\/li>\n<li data-start=\"1793\" data-end=\"1862\"><strong data-start=\"1953\" data-end=\"2011\">Incident reporting and operational continuity<\/strong> implementation of procedures and continuity\/disaster recovery plans (BCP\/DRP).<\/li>\n<li data-start=\"1793\" data-end=\"1862\"><strong data-start=\"2055\" data-end=\"2069\">Governance<\/strong> - clear designation of responsibilities at management level.<\/li>\n<\/ol>\n<h3 data-start=\"2130\" data-end=\"2159\">Support for operators<\/h3>\n<p data-start=\"2160\" data-end=\"2382\">RACA is already in contact with cybersecurity experts and will continue to facilitate the exchange of information and best practices among its members, in order to support compliance with NIS2 requirements.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div dir=\"auto\">\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Asocia\u021bia Companiilor Aeriene Rom\u00e2ne\u0219ti \u201eCarpathia\u201d aduce \u00een aten\u021bia operatorilor din avia\u021bia rom\u00e2neasc\u0103 noile reglement\u0103ri europene privind securitatea cibernetic\u0103 \u0219i obliga\u021biile care decurg din Directiva NIS2.
